Abstract

The Qanun Jinayah of Aceh is a regional legal instrument that reflects the implementation of Islamic law within Indonesia’s national legal framework. Its enforcement, however, has been contested in relation to human rights principles, particularly regarding individual freedoms and protection against discriminatory treatment. This article aims to provide a normative analysis of the decisions of the Mahkamah Syar’iyah (Sharia Court) in criminal cases, focusing on the interplay between the obligation to implement Sharia and Indonesia’s commitment to international human rights standards. The study employs a normative juridical approach by examining relevant qanun provisions, court rulings, and human rights instruments. The findings reveal that the Mahkamah Syar’iyah tends to prioritize legal certainty based on Sharia, yet some decisions indicate efforts to balance the application of qanun with the protection of citizens’ constitutional rights. In conclusion, the implementation of Aceh’s Qanun Jinayah continues to face significant challenges in harmonizing Sharia principles with human rights norms, necessitating progressive judicial interpretation and normative reforms to ensure fair and just legal certainty.
