Abstract

The criminal act of theft committed by a child is a complex issue that requires special handling within the juvenile justice system. In resolving legal cases through Restorative Justice, the term Diversion is commonly used. Diversion is a process of settling criminal cases in which the offender is a child. Diversion is applied in cases where the offender is still a child or under 18 years of age at the time the case occurred. During the diversion process, an agreement is reached that must be approved by both the victim and the offender. One of the agreements involves accountability in the form of compensation. However, in practice, the implementation of compensation accountability in diversion often fails to be realized due to several factors, both internal and external. The types of problem approaches used in this research are Juridical-Normative and Juridical-Empirical (Empirical Legal Research). The data utilized consist of primary and secondary data. The study conducted in this research includes both library research and field research. The data analysis method employed is qualitative analysis. Based on the research findings and discussion, it is shown that: This study indicates that in cases of theft committed by children, the implementation of diversion directly affects how the child offender fulfills the responsibility for compensation. According to Article 6 paragraph (1) of Law No. 11 of 2012 concerning the Juvenile Criminal Justice System, diversion can be carried out at the stages of investigation, prosecution, and examination in the district court, provided that the child commits a criminal act punishable by imprisonment of less than seven (7) years and it is not a repeated offense. However, the implementation of the diversion agreement results is considered less than optimal due to several influencing factors. Based on field observations, the obstacles to diversion can be categorized into internal factors influenced by law enforcement officers involved in handling juvenile cases, as well as legal factors themselves.The recommendation from this study is that the implementation of diversion regarding compensation accountability should include strict sanctions that can be applied for violations of the agreement. This would help prevent breaches in fulfilling the terms of the diversion agreement. Furthermore, law enforcement officers should enhance the quality of supervision in the implementation of diversion agreements to ensure that no violations of the legal principles applicable in Indonesia occur due to misuse or breach of the agreed diversion terms by both parties. This aims to prevent juvenile trials in order to protect the freedom and well-being of the child.
