Abstract

The fast growth of the digital economy has created work arrangements through platforms, which are called the gig economy, characterized by flexible working patterns and algorithmic management. Although gig workers perform actual and productive work and are exposed to high occupational risks, particularly work-related accidents and health issues, Indonesian labour law has not clearly recognized their legal status. As a result, occupational safety and health (OSH) protection cannot be effectively applied to gig workers.

This study aims to examine the urgency of recognizing gig workers’ legal status as subjects of OSH protection in order to achieve legal certainty in Indonesia. This research employs normative legal research methods using statutory, conceptual, and comparative approaches. The analysis focuses on labour law regulations, occupational safety law, and social security frameworks relevant to platform-based work.

The findings demonstrate that the failure of OSH protection for gig workers does not stem from the absence of safety norms, but rather from the lack of legal recognition of gig workers as protected subjects. Without clear legal status, there is no normative basis to determine responsible parties, define obligations, or enforce OSH standards. Therefore, legal recognition of gig workers constitutes a structural prerequisite for the effective operation of OSH protection and the realization of legal certainty within Indonesia’s labour law system.
