This study examines creditor liability in the cancellation of foreclosure auctions of mortgage rights (Hak Tanggungan) and its implications for auction winners acting in good faith. Auction cancellations caused by procedural defects or third-party claims often result in legal and financial losses for auction winners despite lawful participation. This research applies a normative juridical method using statutory, conceptual, and case approaches, focusing on the Mortgage Law and relevant court decisions. The findings demonstrate that creditors, as applicants for foreclosure auctions, are legally obliged to ensure that auction objects are free from disputes and that auctions comply with applicable legal provisions. When an auction is cancelled, creditors may be held responsible for losses incurred by good-faith auction winners. This study highlights the necessity of creditor accountability to ensure legal certainty and effective legal protection within the foreclosure auction system.
