Abstract

This study aims to analyze the legal basis of the Surabaya District Court Determination Number 916/Pdt.P/2022/PN.Sby, which granted an interfaith marriage application between Muslim and Christian petitioners. The analysis focuses on the application of Articles 2(1), 8(f), and 21(3) of Law Number 1 of 1974 on Marriage, which stipulate that the validity of marriage must comply with the respective religious laws of the parties. The findings reveal that the determination reflects a conflict between legality principles and human rights, particularly the right to religious freedom and the right to form a family. The judge adopted a progressive interpretation, considering that interfaith marriage is not explicitly prohibited under Article 8, emphasizing justice, certainty, and the utility of law. The study concludes that although the ruling upholds tolerance and religious freedom, it raises normative tension with Indonesia’s marriage legal system, which is fundamentally based on religious unity in law.
