Abstract

In terms of basic rules, murabahah is considered a valid sales agreement that complies with Islamic law, as long as it adheres to the principles of fairness, transparency, and actual ownership by the bank before the goods are sold to customers. However, the reality in the real world shows that there are violations, such as the use of wakalah contracts that make banks not truly own the goods, a lack of information about base prices and profits, and weak control from the Sharia Supervisory Board. This raises concerns that murabahah is just a new version of interest-bearing loans. By applying a normative legal research approach, this study evaluates the extent to which murabahah practices are compatible with the teachings of the Qur'an, Law Number 21 of 2008, and Fatwa of the National Sharia Council of the Indonesian Ulema Council Number 04/DSN-MUI/IV/2000. The findings show that deep Sharia compliance is crucial as a legal protection tool for customers, through honest contracts, Sharia audits by independent parties, and valid proof of ownership. For this reason, it is recommended that supervision be tightened and the types of financing contracts be increased in order to maintain the integrity of murabahah so that it remains in accordance with Sharia objectives and avoids hidden usury practices.
