This article discusses the crucial relationship between public participation in the legislative process and its implication for legal compliance, using the case study of Indonesian Law No. 39 of 1999 concerning Human Rights (HR Law). From a Socio-Legal perspective, the study argues that procedural legitimacy gained through substantive public involvement is a significant causal factor determining the social effectiveness of a law. The research employed Normative Legal Research supported by a Socio-Legal Approach, utilizing the HR Law as primary material and theories of Responsive Law and Deliberative Democracy as secondary material. The findings indicate that if the formation process of Law No. 39 of 1999 was perceived as lacking substantial participation, it could lead to a social gap between the law in books and the law in action. This gap manifests as formalistic compliance where the law is obeyed only out of fear of sanctions rather than substantive compliance rooted in the collective internalization of HR values. Ultimately, the study concludes that fostering genuine public participation is essential to transforming the HR Law from a mere legal ideal into an effective social instrument capable of changing social interaction patterns and ensuring lasting legal obedience.
