KEBIJAKAN TINGKAT KOMPONEN DALAM NEGERI DITINJAU DALAM PERSPEKTIF PRINSIP NATIONAL TREATMENT WTO

The Domestic Component Level (TKDN) policy is one of Indonesia’s key instruments to strengthen national industries, enhance economic independence, and reduce dependence on imports. This study analyzes the consistency of TKDN with the National Treatment principle within the framework of the World Trade Organization (WTO), particularly the General Agreement on Tariffs and Trade (GATT) 1994 and the Trade-Related Investment Measures (TRIMs), this study employs a normative juridical method through statutory and conceptual approaches, analyzing both primary and secondary legal materials. The findings indicate that TKDN may potentially violate WTO’s non-discrimination principle since mandatory local content constitutes a prohibited performance requirement. Nevertheless, Indonesia may still apply TKDN if done transparently and within WTO’s limited exemption provisions. Therefore, regulatory harmonization and enhanced transparency are essential to ensure TKDN effectively promotes industrial growth while complying with international trade obligations
