Abstract

Economic globalization has increased the complexity of trademark disputes involving foreign elements, necessitating the implementation of an effective Private International Law (IPL) framework. This research is driven by the need to analyze the consistency of Indonesian jurisprudence in protecting foreign Famous Trademarks, as tested through the case of PUMA SE (Germany) v. PUMA (Indonesia). The main issue raised is how the principles of IPL, particularly the qualification of the foreign element and the determination of the applicable law (Lex Causae), are used to resolve cross-border and cross-class trademark cancellation disputes. The purpose of this research is to analyze how the courts qualify the status of the German PUMA Famous Trademark and the role of the finding of Bad Faith in justifying the cancellation of local trademarks. The research findings indicate that the Central Jakarta Commercial Court uses an accommodative IPL approach. First, the court successfully qualified the PUMA trademark as an "Internationally Famous Trademark" based on evidence of a global anchor point, thus overcoming the principle of IPR territoriality. Second, despite applying the Principle of Lex Loci Protectionis (Indonesian Trademark Law) as substantive law, this decision synchronizes domestic law with international obligations (the Paris Convention). Third, Bad Faith in local trademark registrations serves as a defining substantive rule that serves as an enforcement mechanism for the Indonesian Trademark Law (HPI), allowing the cancellation of cross-class trademarks (shoes vs. mosquito repellent) for reputational gain. In conclusion, this ruling confirms that the Indonesian legal system has a responsive HPI framework, providing strong legal certainty for international trademark holders and effectively protecting the goodwill of well-known trademarks from opportunistic registrations. Consequently, this study contributes to the HPI literature by demonstrating how domestic substantive rules (such as Bad Faith) serve as important instruments in the implementation of HPI obligations. It is recommended that the Directorate General of Intellectual Property Rights (DGIP) strengthen the mechanism for preventing bad faith registrations through stricter verification of international link points.
