Abstract

The fundamental need for societal interaction, as evidenced by the classic concept ubi societas ibi ius (where there is society, there is law), inevitably leads to potential conflicts, necessitating legal norms to maintain order. Ideally, law should function not only as a protector but also as a tool for social engineering. However, the Indonesian legal system often falls into a legalistic-formalistic trap, prioritizing static written text over the dynamic realities of society. This gap highlights the urgency of placing Sociology of Law as an empirical examiner and social control mechanism. This study aims to analyze the function of the Sociology of Law through three main lenses: (1) explaining the inherent relationship between the Sociology of Law and society, (2) examining its role as an empirical tester and social control mechanism to measure the empirical validity of legal provisions and public legal awareness, and (3) diagnosing the gaps within the Triadic Model of the Legal System (Substance, Structure, and Legal Culture) that impede law enforcement effectiveness. The study confirms the fundamental nature of the relationship between law and society, where good law should reflect social, economic, and cultural realities. However, the dominance of a formalistic view often sidelines substantive justice for the sake of legal certainty. Using the Triadic Model, the diagnosis reveals that ineffectiveness stems from three factors: (1) Legal Substance suffers from a validity disparity, alienated from living law (e.g., cultural norms of compromise neutralizing child protection laws); (2) Legal Structure is hampered by non-legal sociological factors, where law enforcement officers' discretion is influenced by social bias, leading to inconsistency; and (3) Legal Culture is the most determining element, where collective resistance and dominance of living law demonstrate a lack of public trust in the formal system. The diagnostic role of the Sociology of Law is crucial in mapping the sociological roots of law enforcement ineffectiveness. The effectiveness of Indonesian law depends holistically on the sociological harmonization of Substance, Structure, and Legal Culture. It is recommended that sociological studies be strengthened in the legislative process, that law enforcement officials increase their sociological sensitivity, and that planned legal awareness programs be implemented to create a more just, certain, and beneficial legal system.
