Abstract
Marriage is a very sacred contract in Islam and has broad legal implications, both religiously and socially. The validity of a marriage is not only determined by the existence of a contract, but also depends heavily on the fulfillment of the marriage requirements established in Islamic law. In the study of fiqh munakahat, the requirements for marriage are an important part that often raises issues, especially when there are differences of opinion between schools of thought or practices in society that are not fully in line with the provisions of sharia. This study aims to examine issues in the chapter on marriage related to the requirements for marriage, including the requirements for the prospective husband and wife, guardian, witnesses, and marriage contract. The method used is qualitative research with a legal-normative approach through a literature review of classical fiqh books, laws and regulations, and the opinions of contemporary scholars. The results of the study show that differences in interpretation of the requirements for marriage can affect the validity of a marriage, so a comprehensive and contextual understanding is needed to ensure that the implementation of marriage remains in accordance with the principles of Sharia and positive law. This study is expected to contribute academically to enriching the study of Islamic family law and to serve as a reference in resolving marriage issues in society.
